Acceptable Use Policy
This document comprises your contract with clee.com, inc..
By using services and resources owned by clee.com, inc., you are deemed to have read it, and you agree to abide by it, and observe the following:
The Internet is not the property of any one company or individual, but is shared with millions of others users. Therefore, some basic operating rules are necessary so as to enable all of us to best use this service. This document talks about your rights and responsibilities as a clee.com, inc. user.
clee.com, inc. reserves the right to alter the pricing, offerings, terms and conditions of service at any time. An up to date, online, copy of this document is always displayed at URL http://www.clee.com/policy.htm. It is your responsibility to check for updates, and your continued use of clee.com, inc. services constitutes your agreement to these terms as modified from time to time. This document is under constant review. We consider comments from our users and from experienced staff. We will change this document from time to time. You are subject to the document in effect at the time you sign up for clee.com, inc. services, and to each revision of the document that becomes effective subsequently.
Account Suspension and Cancellation
clee.com, inc. users have the right to cancel their accounts. Cancellations, unless made in the first full month of service, take effect at the end of the month following the month in which you cancel. If you wish to cancel your clee.com, inc. account, you must send notice to clee.com, inc., in writing, at the appropriate address above, or via e-mail to firstname.lastname@example.org.
clee.com, inc. reserves the right to suspend or cancel your account.
If you have paid in advance, and have some credit remaining at the time of your cancellation, clee.com, inc. reserves the right not to refund monies for time unused.
We do not routinely monitor the activity of accounts except for measurements of system utilization and the preparation of billing records. However, in our efforts to promote good citizenship within the Internet community, we will respond appropriately if we become aware of inappropriate use of our service.
By law, you may not upload any commercial software or any other kind of material you don't have the right to share with other people. Likewise, you may not download any software or material you do not have the right or license to use, such as commercial software, from other Internet users. You may not upload anything that will violate local, state, or federal law. If, upon reasonable suspicion and after reasonable investigation, clee.com, inc. finds a violation of this provision, clee.com, inc. will notify appropriate state and/or federal authorities.
Materials that otherwise violate federal, state or local law; and materials and content that threaten the security or utility of the clee.com, inc. network are strictly forbidden.
clee.com, inc. considers the complaints and comments from other users on the clee.com, inc. system, as well as those of system administrators from other Internet Service/Presence Providers. Comments may be e-mailed to email@example.com. We will take immediate action against any clee.com, inc. subscriber who abuses any of our facilities or services. Abuse of our system(s) carries a further penalty of US $1000 or US $500 per man hour required to restore our system(s) to its previous operational order, whichever is greater. Some of the types of conduct which is inappropriate on the Internet, and thus prohibited while using your clee.com, inc. account, are (a non-exhaustive list):
Posting commercial/marketing/advertising/sales materials in non-commercial areas (for example, in a newsgroup dedicated to the discussion of the political significance of the two-party system of government, you should not post a message that you have a watch for sale), or sending unwanted/unsolicited commercial e-mail ("UCE"). This activity is called, aptly enough, "spamming". Simply posting a clause at the end of any bulk e-mail requesting that the user respond in the event that they want to be removed from a bulk e-mail DOES NOT make your bulk e-mail solicited. A thorough explanation of why this activity is bad can be found at http://spam.abuse.net. clee.com, inc. will be the sole arbiter as to what constitutes a violation of this provision. Sending Spam from a clee.com, inc. email account can be a one strike and you are out offense.
Posting "chain letters" is *illegal* under federal and state law, and they are inappropriate on paper and on the Internet. "Make money fast" or "get rich quick" messages are also inappropriate -- even if it says it's legal, it isn't, and is covered under chain letter laws.
E-mailing or posting abusive, vulgar or threatening messages.
Gaining unauthorized access to any network, either by use of an access account that is not yours, or by engaging in otherwise illegal methods.
Engaging in any activity that interferes with other’s use and enjoyment of the Internet.
In addition to this document, the provisions of all applicable laws apply to your use of clee.com, inc. facilities.
The services provided to you by clee.com, inc. may only be used in accordance with applicable laws, statutes, regulations and rules and solely for lawful purposes. Transmission, promulgation, theft, procurement, communication, alteration, publication or storage of any information, protected material or property, data or any other material in violation of any national law of any sovereign nation, any International law, the United States Code, or of any state or local law, regulation or rule is strictly prohibited. This includes, but is not limited to, any material, data, matter, software, intellectual property protected by copyright, trademark, privacy or property right, personal or property right, trade secret, or any statute. Further, it is unlawful and a violation of this document to communicate, transmit, or promulgate in any manner, means or medium, any threatening, harassing, or obscene material, matter, communication of any sort, or to otherwise use clee.com, inc. services for any illegal or unlawful purposes.
You agree that you will indemnify and hold harmless clee.com, inc., its owners, officers, shareholders, agents, employees and its other subscribers from any and all claims, costs, expenses, judgments, causes of action, attorney fees, litigation and court costs, resulting from use of clee.com, inc. services using your identification in any manner, whether directly or indirectly or by any act of omission or commission.
You are solely responsible for the knowledge of and adherence to any and all laws, statutes, rules and regulations pertaining (1) to your use of any clee.com, inc. service, and (2) the communications means by which you connect your terminal, personal computers or other device to clee.com, inc. services or to any services provided by clee.com, inc..
clee.com, inc. has the right to delete all e-mail, data files, or other information that is stored in your account if your clee.com, inc. account is terminated, for any reason, by either you or clee.com, inc..
clee.com, inc. has the right to suspend or cancel your account at any time, for reasonable cause, without notice. "Cause" includes, but is not limited to, nonpayment for services; violation of this document; and use of your account to engage in violation of any federal, state or local law.
No warranty is made by clee.com, inc. regarding any information, services or products provided through, in connection with, or located on the computer systems of clee.com, inc. or any other services provided by clee.com, inc., and clee.com, inc. hereby expressly disclaims any and all warranties, including without limitation (i) any warranties as to the availability of clee.com, inc. products or services, or the accuracy of content or information, products; and (ii) any warranties of merchantability or fitness for a particular purpose.
clee.com, inc. shall have no liability for damages caused or allegedly caused by any failure of performance, error, omission, interruption, electrical surge or damage or interference, deletion, defect, delay in operation or transmission, communication line failure, theft or destruction of or unauthorized access to, alteration of, or use of records whether for breach of contract, tortuous behavior, negligence. When awarded, damages shall be strictly limited to the amount paid by you or on your behalf to clee.com, inc. for the current month.
No agent, employee, or representative of clee.com, inc. has any authority to bind clee.com, inc. to any affirmation, representation, or warranty concerning the services provided by clee.com, inc..
Accounts are billed by the quarter, payable in advance of the first of each quarter.
It is your responsibility to censor or regulate the access to data available to your children, and it is not the responsibility of clee.com, inc., its owners, or employees. You are also responsible for the activities of your children on the Internet, and may be held liable for any illegal or damaging activity conducted by them on-line.
If a particular Web Site, or any product or service offered on any clee.com, inc. server requires you to enter a username or password you are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify clee.com, inc. immediately of any unauthorized use of your account or any other breach of security. clee.com, inc. will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by clee.com, inc. or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.
We provide business email.
We try our best to filter out all Viruses. We do this by filtering email with executable attachments or executable scripts within the email itself. We cannot promise to get all viruses, you still need good anti-virus software on your computer and you need to update the virus definition files frequently (daily).
We try our best to filter out all non-business Email such as Spam (unwanted / unsolicited commercial e-mail) and Email that looks like Spam. We use several IP address Block Listing DNS services that are designed to protect mail servers from open relay and Direct-to-Mail Server Spammers. They are not perfect but it is the best tool we have against SPAM right now.
We filter out non-business Email such as Chain letters. Email with “Send this to every one you know”, “Send this to 15 of your closest friends” and “Send this to everyone in your address list” are chain letters.
We filter out non-business Email such as Urban legends. No, I know it’s hard to believe but if you forward that email to 50 friends you won’t get a free coupon from Applebee’s and Bill Gates is not sending you email so that he can give away his money. Check out that urban legend before show your ignorance by passing it on to others. Look it up on one of these sites:
We filter out non-business Email such as Scams. What are the chances that the Minister of Economic Development of Nigeria would get in touch with you personally to help him illegally launder money from his country?
We filter out non-business Email such as Virus Warnings. You protect yourself from viruses with anti-virus software and subscribing to an anti-virus email service like ours. Not clicking on attachments does not protect you from viruses. It just gives you a false sense of security and sets you up to eventually have a virus destroy your computer.
We filter out non-business Email such as Email that advertises virtually anything free,
Free Cell Phones
We filter out Email sent to more than 10 people. (If it does not commit one of the other email “sins” I pull it from the trash and send it on.)
We filter out Email over 10 MB in size AFTER it is encoded. When your email program encodes that attachment it may double the size of the attachment.
If you feel the need to send or receive things that we filter then you should send or receive them on your computer at home.
If you believe we are filtering something that your business needs to receive then let us know specifically what email that is and who it is from. We will work with you to get that email to you.
If you keep getting spam from some company after you have asked them to stop sending it then forward it to me and I will try to put a stop to it.
